Official Sweepstakes Rules

1. INTRODUCTION

PLEASE READ THESE RULES CAREFULLY PRIOR TO PARTICIPATION OR ENTRY. NO PURCHASE IS NECESSARY TO REGISTER, ENTER, OR WIN. OPEN ONLY TO INDIVIDUALS AGED 18 OR OLDER WHO ARE LEGAL RESIDENTS OF THE UNITED STATES OR THE DISTRICT OF COLUMBIA. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW.

This Agreement is subject to the provisions of the Master Terms and Conditions (“Master”). Any capitalized terms not otherwise defined in this Agreement are defined in the Master. In case of any discrepancies between this agreement and the Master, the terms of the Master shall control. 

These Official Sweepstakes Rules apply to any and all sweepstakes held by Snapcommerce Holdings, Inc. (D/B/A Super.com) or one of its subsidiaries or legal affiliates (collectively “Super”). These Official Sweepstakes Rules—in conjunction with Super.com’s Master, Terms of Use, and Privacy Policy—form a binding contract between Super.com and each Sweepstakes participant (a “Participant”). Entry into this Sweepstakes constitutes a Participant’s full and unconditional agreement to the Official Rules and Super.com’s decisions, which are final and binding in all matters relating to this Sweepstakes. If you do not agree to these Official Rules, do not enter this Sweepstakes.

2. ELIGIBILITY

To be eligible to enter a Sweepstakes or be awarded the Prizes(s) identified on each Sweepstakes’s webpage (each a “Prize”), a Participant must fully comply with these Official Rules. Participants must be at least eighteen (18) years or older at the time of entry.  Participants must legally reside in one of the fifty (50) United States or in the District of Columbia.

Any entry submitted by any ineligible person or persons will be void. Ineligible persons include, but are not limited to: (i) any employees, officers, and/or directors of either Super.com or its third-party contractors who participate in and/or provide services or goods related to the Sweepstakes; and (ii) the immediate family members of (meaning, spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and/or those living in the same household as the employees, officers, and/or directors of Super.com. 

3. SWEEPSTAKES PERIOD

The sweepstakes will begin on Thursday, February 8, 2024 at 11:00AM EST and remain open to submissions until February 19th, 2024 at 11:59PM EST. To be removed from this giveaway, contact [email protected].

4. HOW TO ENTER

To enter for free, Participants must be following the @super account on TikTok, must “like” the post announcing the contest, and must leave a comment on that specific post. Upon completion of the steps listed above, Participants will automatically receive one (1) entry into the Sweepstakes. Participants are limited to one (1) entry over the course of the Sweepstakes (“Sweepstakes’s Entry Limit”). Super.com will determine, in its sole discretion, if a submission adequately fulfills the requirements for entry as specified above. Further, Super.com reserves the right to disqualify any submission it determines to be inaccurate, inappropriate, or otherwise in violation of these terms and conditions.

All entries, once provided, are Super.com’s sole and exclusive property (see “Additional Entry Conditions” for more information). To be removed from this Sweepstakes, you must send an email to [email protected].  Participants may not use multiple email addresses, physical address, login information, devices, or any other evasive tactics used in an effort to procure additional entries over the Sweepstakes’s Entry Limit. A Participant must be the authorized owner of the email address they provide. Multiple Participants may not share the same email address. In the event of a dispute as to the identity of any Participant, the authorized account holder of the email address used to enter will be deemed to be the Participant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. 

By entering this Sweepstakes, you agree that Super.com may contact you via email, phone, text (sms) messaging, and mail in connection with this Sweepstakes in accordance with Super.com’s Terms of Use and Privacy Policy, available at: https://www.super.com/legal#super-2.

5. ADDITIONAL ENTRY CONDITIONS

By entering this Sweepstakes, Participant represents and warrants as follows: (1) that (s)he fully owns or has properly licensed whatever materials or information it submits hereunder in connection with the Sweepstakes and can make such submissions without violating any: applicable law, agreement with any third-party, and/or third-party right of any kind (including without limitation any intellectual property, data protection, privacy, or publicity right); and (2) that any and all materials or information provided by it hereunder shall be true and correct in all respects. Furthermore, without limitation on anything set forth herein to the contrary, Super.com shall have the irrevocable, transferable, and fully sublicensable right and license (but not the obligation) to exploit any and all such materials or information in any manner it so elects to promote the Sweepstakes, its business, brand, products and/or services, throughout the world in perpetuity, and in any and all media, now or hereafter known. 

6. CHOOSING A WINNER

Winner(s) will be selected based on the following criteria: (i) “Liking” the TikTok post that announces the contest, following the @super TikTok account, and (ii) leaving a comment stating which team the Participant is supporting in the “Big Game.” All selection criteria are subject to Super.com’s discretion. The odds of winning depend on the number of eligible entries received from a participant during the Entry Period. Super.com’s selection standards are strictly based on the above criteria. A Potential Winner will be selected automatically using a random comment selector such as Comment Picker or similar software. The Potential Winner will first be notified via TikTok direct message from the @super account, after which the winner will need to provide an email address and phone number for contact. Potential Winner will also need to create a free Super.com account, either through the Super App or through the Super.com website, and provide Super.com with the email and phone number matching the one they use to set up the account. Travel credits will be added to the winner’s Super.com account within 72 hours of confirming the creation of their account.

7. CONFIRMATION OF THE WINNER

A Potential Winner will only be confirmed as the winner eligible to receive the Prize after Super.com has completed verification of Potential Winner’s eligibility to win and confirmed Potential Winner’s compliance with the terms of these Official Rules and the Master. To receive the Prize(s), and as part of the Winner confirmation and verification process, Potential Winner must accurately complete and timely return all documents necessary to confirm and verify a Potential Winner’s eligibility, as determined by Super.com, in its sole discretion (collectively, the “Winner Documentation”). Potential Winner must fully and accurately complete Winner Documentation and timely return all such documentation by the date specified by Super.com, or the Potential Winner may be disqualified and will forfeit any claim to any of the Prizes(s). Potential Winner will need to create a free Super.com account, either through the free Super App (available on the Apple App Store and Google Play Store) or through the Super.com website, and provide Super.com with the email and phone number matching the one they use to set up the account. Travel credits will be added to the winner’s Super.com account within 72 hours of confirming the creation of their account.

As part of the Winner confirmation and verification process Super.com may conduct background check(s) on a potential winner except where legally prohibited. Participation in this Sweepstakes constitutes Participant’s authorization to such background checks without Super.com obtaining prior consent. Super.com’s decisions are final and binding in all matters related to the administration, operation, drawing, verification of the Winner, and all issues related to this Sweepstakes. 

8. NOTIFYING THE WINNER

Potential Winners will be first contacted via a TikTok direct message to the account associated with their Entry. Potential Winners must respond within twenty-four (24) hours of the email being sent (or within the time frame indicated in the Potential Winner notification email, if another time frame other than twenty-four (24) hours is specified). Potential Winner must provide a valid email address and phone number for confirmation of free Super.com account creation within 72 hours of notification.

Super.com is not responsible for emails that are undeliverable as a result of any filtering of any kind, insufficient space in a Participant’s account, or any other failure beyond its reasonable control. In the event of a dispute with respect to entries received from more than one user having the same account name, the authorized subscriber of the account in question at the time of entry will be deemed the proper entrant. If a Potential Winner fails to respond to the email within the stated period, Potential Winner may be disqualified and, in such instances, will forfeit any claim to any of the Prizes(s). By entering, Potential Winners expressly authorize Super.com to name, tag, or otherwise identify Potential Winner on the Site, social media pages, and/or in Super.com’s other promotional materials.

9. PRIZE

Winners will receive Travel Credits to use for booking a hotel via Super.com or through the Super App equal to one thousand, nine-hundred eighty-nine dollars ($1,989.00 USD), subject to any restrictions expressly stated in the Official Rules or Master. Winners are solely responsible for all taxes, costs, and fees associated with Prize receipt, ownership, and/or use. Winners may be required to complete and return an IRS W-9 form, W8-BEN, or other applicable forms (i.e., Request for Taxpayer Identification Number and Certification).  Super.com will not replace any lost or stolen Prize(s) or components of a Prize(s). ‍

10. DISCLAIMER

This Sweepstakes, while potentially engaging with social media platforms, is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or any other third party social media site (the “Social Media Sites”) and in no instance shall the Social Media Sites or their subsidiaries, legal affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (all of the foregoing, the “Social Media Sites Parties”) be liable for any disputes, claims, causes of action or controversies arising out of or in connection with a Social Media Sweepstakes.

11. ADDITIONAL TERMS 

THE TERMS OF USE CONTAIN A CLASS ACTION WAIVER AS WELL AS AN ARBITRATION PROVISION, WHICH REQUIRES YOU TO ARBITRATE ANY CLAIMS (WITH CERTAIN EXCEPTIONS) YOU MAY HAVE AGAINST SUPER ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND THAT YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY IN ANY FORUM, AS DESCRIBED IN THE TERMS OF USE. 

YOU MAY ENTER AND MAY WIN WITHOUT MAKING A PURCHASE, PAYMENT OR DONATION.  YOUR ODDS OF WINNING INCREASE WITH MORE ENTRIES, BUT EACH SINGLE ENTRY HAS AN EQUAL CHANCE OF WINNING AS ANY OTHER ENTRY.

All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of Participants and Super.com in connection with a Giveaway, shall be governed by, and construed in accordance with, United States federal law and the laws of the State of Delaware, without giving effect to the conflict of laws rules thereof.

A list of winner(s) may be provided upon request.

Each of the terms of these Official Rules operates separately.  If any court of relevant authority decides that any of them are unlawful or unenforceable, the remaining terms will remain in full force and effect.

If Super.com fails to insist that Participant perform any of Participant’s obligations under these Official Rules, or if Super.com does not enforce its rights against Participant, or if Super.com delays in doing so, that will not mean that Super.com has waived its rights against Participant and will not mean that Participant does not have to comply with these obligations.  If Super.com does waive a default by Participant, Super.com will only do so in writing, and that will not mean that Super.com will automatically waive any later default by Participant.

These Official Rules, in conjunction with the Master, constitute the entire agreement between Super.com and Participant with respect to the Sweepstakes and supersede all prior or contemporaneous communications, whether electronic, oral or written, between Super.com and Participant with respect to the Sweepstakes.
