This Agreement is subject to the provisions of the Master Terms and Conditions (“Master”). Any capitalized terms not otherwise defined in this Agreement are defined in the Master. In the event of any discrepancies between this agreement and the Master, the terms of the Master shall control.

These Official Giveaway Rules apply to any and all giveaways held by Snapcommerce Holdings, Inc. (D/B/A Super.com) or one of its subsidiaries or legal affiliates (collectively “Super”). These Official Giveaway Rules—in conjunction with Super’s Master, Terms of Use, and Privacy Policy—form a binding contract between Super and each Giveaway participant (a “Participant”). Entry into this Giveaway constitutes a Participant’s full and unconditional agreement to the Official Rules and Super’s decisions, which are final and binding in all matters relating to this Giveaway. If you do not agree to these Official Rules, do not enter this Giveaway.

2. Eligibility

Participants must legally reside in one of the fifty (50) United States or in the District of Columbia. Any entry submitted by any ineligible person or persons will be void. Ineligible persons include, but are not limited to: (i) any employees, officers, and/or directors of either Super or its third-party contractors who participate in and/or provide services or goods related to the Giveaway; and (ii) the immediate family members of (meaning, spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and/or those living in the same household as the employees, officers, and/or directors of Super.

3. Giveaway - General Provisions

Only the first one hundred (100) customers who use the promotional code (“promo code”) LOVETRAVEL will receive a fourteen percent (14%) discount, up to two hundred dollars ($200), on a hotel booking made through Super.com. Customers are limited to one use of the promo code LOVETRAVEL per person; any individual found to have utilized the promo code for more than one transaction may have all bookings in which the code was utilized canceled.Promo code cannot be used on prior purchases. Participants must pay applicable sales tax. Offer may not be combined with any other sale, promotion, discount, code, coupon and/or offer. Promotions have no cash value. Offer cannot be sold or otherwise bartered. Void where prohibited, taxed, or otherwise restricted. Returns of any portion of the purchase will require equal forfeiture of offer or amount equal to offer. Super reserves the right to end or modify any promotion at any time.

4. Giveaway Period

The giveaway will begin and end on FEBRUARY 5, 2024 between 12:01 AM to 11:59 PM EST. Only the first one hundred (100) Participants who use the promo code LOVETRAVEL will be able to access the discount.

5. How to Use

Participants may not use multiple email addresses, physical address, login information, devices, or any other evasive tactics used in an effort to procure additional entries over the Giveaway’s Entry Limit. A Participant must be the authorized owner of the email address they provide. Multiple Participants may not share the same email address. In the event of a dispute as to the identity of any Participant, the authorized account holder of the email address used to enter will be deemed to be the Participant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

By entering this Giveaway, you agree that Super may contact you via email, phone, text (SMS) messaging, and mail in connection with this Giveaway in accordance with Super’s Terms of Use and Privacy Policy, available at: https://www.super.com/legal#super-2.

6. Disclaimer

This Giveaway, while potentially engaging with social media platforms, is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or any other third party social media site (the “Social Media Sites”) and in no instance shall the Social Media Sites or their subsidiaries, legal affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (all of the foregoing, the “Social Media Sites Parties”) be liable for any disputes, claims, causes of action or controversies arising out of or in connection with a Social Media Giveaways.

7. Additional Terms

The terms of use contain a class action waiver as well as an arbitration provision, which requires you to arbitrate any claims (with certain exceptions) you may have against super on an individual basis. Arbitration on an individual basis means that you will not have, and that you waive, the right for a judge or jury to decide your claims, and that you may not proceed in a class, consolidated, or representative capacity in any forum, as described in the terms of use.

All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of Participants and Super in connection with a Giveaway, shall be governed by, and construed in accordance with, United States federal law and the laws of the State of Delaware, without giving effect to the conflict of laws rules thereof.

Information collected from Participants is subject to the Super’s Privacy Policy, available at https://www.super.com/legal#super-2. Super’s contact information is: Snapcommerce Holdings, Inc. Each of the terms of these Official Rules operates separately.  If any court of relevant authority decides that any of them are unlawful or unenforceable, the remaining terms will remain in full force and effect.

If Super fails to insist that Participant perform any of Participant’s obligations under these Official Rules, or if Super does not enforce its rights against Participant, or if Super delays in doing so, that will not mean that Super has waived its rights against Participant and will not mean that Participant does not have to comply with these obligations.  If Super does waive a default by Participant, Super will only do so in writing, and that will not mean that Super will automatically waive any later default by Participant.

These Official Rules, in conjunction with the Master, constitute the entire agreement between Super and Participant with respect to the Giveaway and supersede all prior or contemporaneous communications, whether electronic, oral or written, between Super and Participant with respect to the Giveaway.

All decisions of super and sponsor parties are final and binding in all respects.

Disclaimer Language

On Monday, February 5th, 2024 from 12:01 AM to 11:59 M EST, Super.com will offer 14% off sitewide, up to $200, with code LOVETRAVEL to the first one hundred (100) customers to apply the code to their purchase. The promo code cannot be combined with other promo codes, applied to previous purchases, gift cards, redeemed for cash, or combined with any other offers. Tax and additional fees are not included in calculating discounts. Super.com reserves the right to change this offer and its terms at any time, including ceasing the offer.
